Clip Art in E-mail advertisements

I have a two-fold question:
1. Can I use Clip Art in E-mail advertisements?
2. If I can, how to I turn one into a background image?

I would like to make sure that their use is legal (definitely would be
helpful) and how to use them to the fullest potential
